Federal Communication Commission Interference Statement:

This device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.

This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to Part 15 of the FCC Rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harmful interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one of the following measures:

- Reorient or relocate the receiving antenna.

- Increase the separation between the equipment and receiver.

- Connect the equipment into an outlet on a circuit different from that to which the receiver is connected.

- Consult the dealer or an experienced radio/TV technician for help.

FCC Caution: Any changes or modifications not expressly approved by the party responsible for compliance could void the user's authority to operate this equipment.

This transmitter must not be co-located or operating in conjunction with any other antenna or transmitter.

Radiation Exposure Statement:

This equipment complies with FCC radiation exposure limits set forth for an uncontrolled environment. This equipment should be installed and operated with a minimum distance 20 cm between the apparatus & your body.

2.412-2.472GHz Band

This device operates in the 2.412-2.472GHz range.

5.15-5.25GHz Band

Operations in the 5.15-5.25GHz band are restricted to indoor use only.

Slave Equipment

This device is slave equipment, the device is not radar detection and not ad-hoc operation in the DFS band.

Industry Canada Statement

This device complies with ISED’s license-exempt RSSs. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.

Caution:

(i) the device for operation in the band 5150-5250 MHz (5.15-5.25 GHz) is only for indoor use to reduce the potential for harmful interference to co-channel mobile satellite systems.

(ii) where applicable, antenna type(s), antenna models(s), and worst-case tilt angle(s) necessary to remain compliant with the e.i.r.p. elevation mask requirement set forth in section 6.2.2.3(b) shall be clearly indicated.

Radiation Exposure Statement:

This equipment complies with ISED radiation exposure limits set forth for an uncontrolled environment. This equipment should be installed and operated with greater than 20cm between the apparatus & your body.

WARNING: Medical Issues

Restrict tactile sensation to the user's hands. Do not direct tactile sensation toward the face, head, torso or any other parts of the body. Do not direct tactile sensation toward any person other than yourself. Be aware that placement/projections of tactile content may occur even when the user is unaware that the apparatus is in active mode ("On").

If you have any medical condition, are pregnant or experience symptoms that you believe could be affected by the apparatus, its haptics or tactile sensations (including without limitation pain, cramps, seizures, blackouts, or headaches), consult with your physician prior to using the apparatus. Stop using the apparatus immediately and consult a doctor if you experience any serious or persistent symptoms.

WARNING: Power and Installation

Place the apparatus on an open, flat and level surface such as a table or bench in a well-ventilated, climate-controlled location.

Install in accordance with the manufacturer's instructions.

Confirm that your electrical outlet provides the type of power required by the apparatus in terms of voltage [V] and frequency [Hz]. If you are unsure of the type of power supplied to your location, consult a qualified electrician.

Do not defeat the safety purpose of the polarized or grounding-type plug. A polarized plug has two blades with one wider than the other. A grounding type plug has two blades and a third grounding prong. The wide blade or the third prong are provided for your safety. If the provided plug does not fit into your outlet, consult an electrician for replacement of the obsolete outlet.

Do not plug multiple electric devices into the same wall socket with the apparatus. Overloading a socket can cause it to overheat and may result in a fire.

Do not use non-standard power sources, such as generators or inverters, even if the voltage and frequency appear acceptable. Use only AC power provided by a standard wall outlet.

Do not connect or disconnect any cables or perform installation, maintenance, or reconfiguration of the apparatus during an electrical storm.

Unplug the apparatus during electrical storms or when unused for long periods of time.

Only use the included AC adapter with the apparatus.

Do not use the apparatus AC adapter with other devices.

If the AC adapter or power cord appears damaged, discontinue use immediately and contact customer support (emerge.io/support) for a replacement.

Do not pull on the cord to unplug. To disconnect the apparatus from power, pull at the plug.

To reduce potential trip or entanglement hazards, arrange cables and cords so that people and pets are not likely to trip over or accidentally pull on them as they move around or walk near the apparatus.

Do not allow children to play with the AC adapter.

The apparatus may get warm during use. This is normal.

WARNING: Cleaning and Maintenance

To reduce the risk of fire or electric shock, do not expose the apparatus to water or moisture.

Avoid exposing the apparatus to extreme heat or cold.

Do not use the apparatus near food, excessive dirt, dust, oil, chemicals, or in strong direct sunlight.

Do not place any object on top of the apparatus.

Clean the apparatus with a dry cloth only when the apparatus is off and unplugged. When the apparatus is plugged in, voltage may be present in the power supply even if the power switch is Off.

Do not attempt to dry the apparatus with an external heat source such as a blow dryer.

Do not use compressed air to clean the apparatus.

Do not block any ventilation openings on the apparatus.

Do not install the apparatus near any heat sources such as amplifiers, radiators, heat registers or stoves.

Do not place naked flame sources, such as lighted candles, on or near the apparatus.

Do not store or carry flammable liquids, gases, or explosive materials in the same compartment as the apparatus, its parts, and/or accessories.

Turn off the apparatus, and do not remove or install battery chargers, AC adapters, or any other accessory for the apparatus when you are in an area where flammable chemicals or particles have collected in the air. In such areas, sparks can occur and cause an explosion or fire.

Never turn the apparatus on when there is evidence of fire, water, or structural damage.

Do not use the apparatus when the ambient temperature is above 113 °F (45 °C).

Protect the power cord from being walked on or pinched, particularly at plugs and the point where it exits the apparatus.

Parts of the apparatus are magnetic. Do not place metallic items, magnetically sensitive devices, credit cards, and other magnetic storage media near the apparatus to reduce the potential for damage, magnetic interference, disruption of medical device operation and corruption of magnetically stored data.

Only use attachments and accessories authorized by the manufacturer or sold with the apparatus.

When using a cart for the apparatus, exercise caution when moving the cart/apparatus combination to avoid injury from a tip-over.

WARNING: Service

Service is required when the apparatus has been damaged, including without limitation if the power cord or plug is damaged, objects have fallen into the apparatus, the apparatus has been exposed to water or moisture, does not operate normally, or was dropped. To reduce the risk of electrical shock do not open the apparatus. For safety reasons the apparatus may only be opened by qualified service personnel. Refer all servicing to qualified service personnel.

WARNING: Radio Frequency Transmission

The apparatus emits radio frequencies that may interfere with personal medical devices (such as pacemakers, hearing aids, and defibrillators). If you have personal medical device issues, consult with your physician or the device manufacturer before using the apparatus. Failure to do so may lead to property damage, personal injury and/or death.

The apparatus generates, uses, and can radiate radio frequency (RF) energy and, if not used in accordance with its instructions, may cause interference to radio communications and electronic equipment. External RF signals may affect improperly installed or inadequately shielded electronic operating systems, entertainment systems, and personal medical devices. While most modern electronic equipment is shielded from external RF signals, if in doubt check with the manufacturer of the item in question before using the apparatus.

Follow all crew instructions while on an aircraft. Turn off the apparatus as instructed by the crew. Follow crew instructions for wireless devices. Consult airline staff or crew about using the apparatus in flight.

Follow all the facility rules and posted instructions in areas where cellular or wireless network use is prohibited.

Warranty

1-Year Limited Warranty

Emerge Now Inc. ("Emerge") warrants to the original retail purchaser that the Emerge products accompanying this limited warranty (individually a “Product” and collectively the “Products”), will be free from defects in materials and workmanship for a period of (1) one year from the date of purchase, under normal use and conditions. Should a Product prove to be defective in materials or workmanship during the foregoing warranty period, Emerge will, at its option: (a) repair the Product; or (b) replace the Product. If the Product model is no longer available and cannot be repaired effectively or replaced with an identical model, Emerge may, in its sole and absolute discretion, replace the Product with a current model of equal or greater value.

If you are a purchaser in Quebec, any Product repaired or replaced by Emerge will continue to be covered by this warranty for the greater of: the remainder of the 1-year limited warranty period or ninety (90) days following your receipt of the replacement or repaired Product. Additionally, subject to the Quebec Consumer Protection Act, the warranty period is extended for a period equal to the time during which Emerge has had the Product or a part of the Product in its possession for the performance of the warranty.

To obtain warranty service, please visit the Emerge website at emerge.io/support. You will be required to provide an original receipt or bill of sale, identifying you as the original purchaser and identifying the purchase was made through an authorized Emerge retailer. You may also be required to ship the Product, prepaid and insured, together with the proof of purchase to a location designated by Emerge in its sole discretion. Risk of loss or damage in transit shall be borne by the purchaser. Freight collect shipments will be refused.

This limited warranty is non-transferable, and it is void and does not apply to any Product: (c) that has been modified or used in a manner contrary to its intended purpose; (d) for which you fail to provide a continuously suitable installation environment; (e) that has an altered or missing serial number; (f) that was purchased from someone other than an authorized dealer; and/or (g) damaged by accident or unreasonable use, neglect, improper service or other causes not arising out of defects in materials or workmanship. Product(s) which are found by Emerge to be damaged by abuse are not covered by this warranty but may be replaced by Emerge. The determination regarding damage by abuse and the decision regarding Product replacement will both be made by Emerge in its sole discretion.

This limited warranty terminates if you sell or otherwise transfer the Product to another party. This limited warranty does not cover cosmetic damage, paint damage, damage to other components, parts or premises, or consequential damages which may result from any cause, to the fullest extent allowed by applicable law.

Emerge does not warrant that any Product will operate without interruption or that any Product will operate error-free. Certain external conditions which are out of Emerge’s control may affect the overall performance of Products, including but not limited to wireless network configuration, performance of the wireless network, distances between the Products and wireless network connection and/or content sources, third party devices, or radio and/or environmental interference with the Product.

Emerge may offer access to third party content or third party content providers via the Product. Emerge reserves the right to alter, change, discontinue or modify access to any third party content or any third party content provider at any time, for any reason. Emerge disclaims all warranties and representations offered by any third party content or third party content provider. Emerge shall have no obligation to provide any updates or upgrades to any Product, but if it does, such updates and upgrades shall be deemed part of the applicable Product, and shall be subject to the terms and conditions herein.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE/PROVINCE TO PROVINCE. ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO EXPRESS WARRANTIES SUCH AS THE WARRANTY IN OUR TERMS OF SERVICEY, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THE IMPLIED CONDITION OF SATISFACTORY QUALITY ARE EXPRESSLY EXCLUDED AND DISCLAIMED TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW. EMERGE DOES NOT ASSUME ANY LIABILITY IN CONNECTION WITH THE SALE OF ANY PRODUCT. EMERGE HAS ABSOLUTELY NO LIABILITY FOR ANY ACTS OF THIRD PARTIES. SOME STATES/PROVINCES DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, OR CONDITIONS ON AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. EMERGE DOES NOT ACCEPT LIABILITY FOR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST SAVINGS OR DAMAGES RESULTING FROM IMPROPER USE, OR THE INABILITY TO USE ANY PRODUCT. THE MAXIMUM LIABILITY FOR WHICH EMERGE MAY BE RESPONSIBLE IN CONNECTION WITH ANY PRODUCT SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE YOU PAID FOR THE PRODUCT. SOME STATES/PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSIONS MAY NOT APPLY TO YOU.

If you are a purchaser in Quebec, the exclusion of warranties and the limitations of liability in the above paragraph do not limit your rights and remedies under the Quebec Consumer Protection Act, including the right to make a claim under any of the statutory warranties provided under sections 34 to 54 thereof.
